The central aim of the amendment is to ensure that, when concern or doubt for a person’s capacity is expressed, an assessment is triggered so that the Mental Capacity Act 2005 (MCA) can be used to secure their best interests. This will improve the law and practice around the use of the Mental Capacity Act.

We believe that if this amendment, if previously in place, could have save the life of Fiona's son - Christopher - and many others in his circumstances.

ITV discussed Christopher's story and the amendment in detail on their What You Need to Know podcast.

After ITV news spoke about Christopher's story, they asked if the Minister will be considering Fiona's amendment.
